La Corte Suprema acogió recurso de casación y ordenó a la demandada pagar por las reparaciones realizadas a las losetas que recubren matrices de agua potable que abastecen las torres de la remodelación San Borja.
En fallo unánime (causa rol 12.964-2018), la Cuarta Sala del máximo tribunal –integrada por los ministros Ricardo Blanco, Gloria Ana Chevesich, Andrea Muñoz, Mauricio Silva Cancino y María Angélica Repetto– estableció que la parte demandada deben responder por los daños provocados en el segundo subterráneo de edifico de calle Marcoleta 350.
“Que, para una mejor comprensión del asunto sometido al conocimiento de esta Corte, conviene tener presente que el artículo 76 del Código de Aguas establece, en su inciso primero, que ‘la servidumbre de acueducto es aquella que autoriza a conducir aguas por un predio ajeno a expensas del interesado’ y agrega que ‘la servidumbre comprende el derecho de construir obras de arte en el cauce y de desagües para que las aguas se descarguen en cauces naturales’. Se trata de una servidumbre legal y, por lo tanto, obligatoria para el predio sirviente, siempre que se cumplan los requisitos que la ley establece, de la que sólo podrá aprovecharse para los fines para los cuales se ha constituido, salvo acuerdo de los interesados. Es positiva, continua y, por regla general, aparente”, sostiene el fallo.
La resolución agrega que: “El artículo 77 del Código de Aguas, a su vez, establece: ‘Toda heredad está sujeta a la servidumbre de acueducto a favor de un pueblo, industria, mina u otra heredad que necesite conducir aguas para cualquier fin’, con la excepción contemplada en el artículo 80, que excluye a los edificios, instalaciones industriales y agropecuarias, estadios, canchas de aterrizaje y las dependencias de cada uno de ellos (…). Por su parte, el artículo 78 del mencionado texto legal establece como regla general que ‘la conducción de las aguas se hará por un acueducto que no permita filtraciones, derrames ni desbordes que perjudiquen a la heredad sirviente; que no deje estancar el agua ni acumular basuras y que tenga los puentes, canoas, sifones y demás obras necesarias para la cómoda y eficaz administración y explotación de las heredades sirvientes’, y su inciso segundo: ‘La obligación de construir las obras se refiere a la época de la constitución de la servidumbre'”.
Para el máximo tribunal: “Desde ya se debe dejar sentado que el inciso primero establece la regla general respecto de las obligaciones que debe cumplir siempre el dueño de la servidumbre de acueducto, siendo importante consignar que no todas las obligaciones consagradas en él dicen relación con construcción de obras. En este sentido, el alcance del inciso segundo sólo se refiere a las obras que en general pudieron preverse al tiempo de la construcción del canal”.
“A su turno –prosigue–, el artículo 87 señala: ‘La servidumbre de acueducto se ejercerá, por regla general, en cauce a tajo abierto.
El acueducto será protegido, cubierto o abovedado cuando atraviese áreas pobladas y pudiere causar daños o cuando las aguas que conduzca produjeren emanaciones molestas o nocivas para sus habitantes.
Asimismo, se deberán instalar las protecciones que el dueño del predio sirviente, con expresión de causa, requiera. La obligación de abovedar el cauce, instalar protecciones u obras destinadas a evitar daños o molestias, no será de cargo de su dueño, cuando esta necesidad se origine después de la construcción de aquél, sin perjuicio de que contribuya a los gastos de las obras, en la medida que éstas le reporten beneficios.
Las dificultades que se produzcan con motivo de la aplicación de lo dispuesto en los incisos anteriores, serán resueltas por la Justicia Ordinaria’.
Resulta relevante, además, para efectos de la correcta resolución de la litis, lo dispuesto en el artículo 91 del Código de Aguas, que señala: “el o los dueños del acueducto deben mantenerlo en perfecto estado de funcionamiento, de manera de evitar daños o perjuicios a las personas o bienes de terceros. En consecuencia, deberán efectuar las limpiezas y reparaciones que corresponda.
El incumplimiento de estas obligaciones hará responsables al o a los dueños del acueducto del pago de las indemnizaciones que procedan, sin perjuicio del pago de la multa que fije el tribunal competente'”.
Por tanto: “a la luz de la normativa reseñada, es el predio dominante en la servidumbre de acueducto, el beneficiado directamente con la conducción de las aguas, el que debe adoptar las medidas concretas pertinentes para reparar el acueducto, como se desprende del tenor del artículo 91 del mencionado texto legal, que dispone que es el dueño de la servidumbre de acueducto quien debe velar por mantenerlo en perfecto estado de funcionamiento, de manera de evitar daños o perjuicios a las personas o bienes de terceros y de lo dispuesto en el inciso segundo del artículo 861 del Código Civil, en virtud del cual, la servidumbre de acueducto consiste en que puedan conducirse las aguas por la heredad sirviente a expensas del interesado; y está sujeta a las reglas que prescribe el Código de Aguas”, afirma la resolución.
“En consecuencia, habiéndose acreditado la existencia de la servidumbre de acueducto y que transcurre por el segundo subterráneo del inmueble de la demandante, necesariamente se debía concluir que el predio de la demandada era el predio dominante y no exigir al actor que probara esa calidad, ya que su predio es precisamente el sirviente que debe soportar el paso de las aguas, razón por la cual no sólo se vulneran las normas relativas a la servidumbre de acueducto, sino también, el onus probandi, errores que de forma evidente tuvieron influencia substancial en lo dispositivo de la sentencia impugnada, pues de no haberse incurrido en él se habría acogido la demanda, por lo que corresponde hacer lugar al recurso”, concluye.
